Intellectual Property Notice and Takedown
We respect the intellectual-property rights of others and require our users to do the same. This page explains how to report content on Midium that you believe infringes a copyright, trade-mark, patent, design right, or other intellectual-property right, and how the Operator handles such reports under the United States Digital Millennium Copyright Act ("DMCA"), the European Union Copyright Directive, and equivalent rules in other jurisdictions.
Filing a notice of infringement (DMCA notice)
To report content that you believe infringes a copyright, trade-mark, or other intellectual-property right, send a notice to dmca@midium.live. To be effective, your notice must include all of the following:
- The name, postal address, telephone number, and email address of the rights-holder or of an authorised agent acting on the rights-holder's behalf.
- A clear identification of the work or other subject-matter that you claim has been infringed.
- A clear identification of the material on the Service that you claim is infringing, including the URL, the in-app screen name, the username, or another identifier sufficient for us to locate the material.
- A statement that you have a good-faith belief that the use of the material is not authorised by the rights-holder, the rights-holder's agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights-holder or are authorised to act on the rights-holder's behalf.
- The physical or electronic signature of the person submitting the notice.
Notices that omit any required element may not be processed and may be returned to you for correction. Knowingly submitting a materially false notice can give rise to liability for damages and legal costs.
What we do when we receive a valid notice
On receipt of a notice that meets the requirements above we will, in our discretion and as appropriate to the circumstances: expeditiously remove or disable access to the material; notify the user who posted the material; forward the notice (with the rights-holder's contact details redacted as appropriate) to the user; and, in cases of repeated infringement, take action against the user under our Acceptable Use Policy, up to and including permanent termination of the account.
Counter-notice
If your content was removed or disabled and you believe in good faith that this was a mistake or that the material was misidentified, you may submit a counter-notice. To be effective, a counter-notice must include all of the following:
- Your name, postal address, telephone number, and email address.
- A clear identification of the material that was removed or disabled, and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or — if your address is outside the United States — to the jurisdiction of any judicial district in which the Operator is found, and that you will accept service of process from the rights-holder or the rights-holder's agent.
- Your physical or electronic signature.
Send counter-notices to dmca@midium.live. On receipt we will forward your counter-notice to the original complainant. Unless the complainant notifies us within ten business days that they have filed a court action seeking an order against you, we will, in our discretion, restore the material.
Repeat infringers
It is our policy to terminate the accounts of users who, in appropriate circumstances, are determined to be repeat infringers.
Trade marks, patents, and other intellectual-property rights
For trade-mark, patent, design-right, or other non-copyright intellectual-property complaints, send the same information as above (adapted as appropriate) to dmca@midium.live. Where applicable law provides a different procedure (for example, in the European Union under Article 17 of the Copyright Directive, or in the United Kingdom under the Online Safety Act regime), we will follow the procedure required by that law.
Designated agent (United States)
For DMCA purposes the designated agent of the Operator is reachable at dmca@midium.live with the postal address of the Operator's registered office. We update our designated-agent registration with the U.S. Copyright Office in line with applicable rules.
Misuse of this process
We take the abuse of this process seriously. Submitting a knowingly false notice or counter-notice may make you liable to the other party for damages and legal costs. We may, in our discretion, decline to act on notices we determine to be unfounded, vexatious, or sent for an improper purpose.
Open-source software and attributions
Midium is built with open-source software, which we gratefully acknowledge. In particular, user avatars are generated with the "Pixel Art" style from DiceBear, dedicated to the public domain under CC0 1.0; the DiceBear library itself is made available under the MIT licence. No attribution is required for these components — we credit their authors here as a courtesy.
